INCOME TAX ACT SECTION 23 INCOME FROM HOUSE PROPERTY

Q.1 – Section 23 में कितने प्रकार की house property को define किया गया है?
Ans. – Section 23 के according तीन प्रकार की house property होती है:-
• Self-Occupied Property (SOP);
• Let Out House Property;
• Deemed to be let out Property.

Q.2 – जो property पुरे साल let out की गयी है उसकी Gross annual value (GAV) कैसे compute की जाएगी?
Ans. – Following तरीको से GAV determine होगी जो की higher of–
Step 1) Compute reasonable Expected Rent (Higher of) Fair rent, Municipal value; (but restricted to standard rent)
Step 2) Compute Actual Rent of the property

Q.3 – क्या assessee हर साल अपने self-occupied property declare करने का option change कर सकता है?
Ans. – हाँ, अगर assessee के पास 2 से ज्यादा self-occupied property है तो सिर्फ 2 self-occupied property के लिए ही annual value को nil ले सकते है और assessee ये option year to year change कर सकता है.

Q.4 – क्या municipal tax का deduction due basis पर मिल सकता है?
Ans. – नहीं, municipal tax का deduction सिर्फ payment basis पर ही allowed है.

Q.5 – Vacancy period के rent और Unrealized rent का tax treatment क्या होगा?
Ans. – Vacancy period के rent का actual rent में से कोई deduction नहीं मिलेगा, वहीं Unrealized rent का actual rent से deduction मिलेगा जब तक निम्नलिखित दी गई conditions को follow किया गया हो:–
• Tenant वास्तविक अथवा bona fide होना चाहिये;
• Defaulting tenant से property vacant हो जानी चाहिये;
• Assessee की कोई और property Defaulting Tenant को let out नहीं की होनी चाहिये;
• Assessee ने Unrealised rent को Recover करने के लिए Reasonable Steps ले लिए हो.

Q.6 – कौन से assessee को दो self-occupied property declaration का option available है?
Ans. – सिर्फ दो assessee को यह option available है:-
• Individual; या
• HUF

Q.7 – अगर property partly let out है तो उस case में fair rent, municipal value, standard rent, actual rent, municipal tax, interest on loan का computation कैसे होगा?
Ans. – हम fair rent, municipal value, standard rent, municipal tax, interest on loan को let out portion और self-occupied portion के area basis में divide कर देंगे, लेकिन actual rent को हम हमेशा let out portion में consider करेंगे.
