Q.1 - यह section कब से applicable हुआ?
Ans. - यह section 1st July, 2017 से applicable हुआ है.

Q.2 - Liability of officers and certain other person’s को समझने के लिए और दूसरे कौन से sections या rules को refer करना होगा?
Ans. - Liability of officers and certain other person’s को समझने के लिए CGST Act, 2017 के Section 133 को refer कर सकते हैं.

Q.3 - CGST Act 2017 के Section 133 में कौन से officer’s या person’s की liability को mention किया गया है?
Ans. - CGST Act 2017 के Section 133 में officer’s या person’s की liability वो है जो निचे बताई गई हैं:
• जहां कोई person जो Section 151 (Power to call for information) के according किसी भी तरह का data collect करता है , या उसी data को compile or computerization करता है; या

• जहां कोई भी Central Tax का officer जो Section 150 (1) में दी गई information को access कर सकता है; या

• अगर कोई भी person जो common portal की services से related है या उसका agent है.

Q.4 - CGST Act 2017 के Section 133 में दिए गए Officer या Person अगर कोई भी information disclose करता है तो ऐसे case में क्या किया जाएगा?
Ans. - और यदि CGST Act 2017 के Section 133 में बताए गए किसी officer या person ने intentionally कोई भी information या contents of return जो की इस Act/Rules के accordingly file किया गया है disclose करता है, तो ऐसे case में उन्हें 6 महीने तक की जेल या fine जो Rs.25,000/- CGST and Rs.25,000/- SGST तक लगाया जा सकता है या fine and imprisonment दोनों दी जा सकती हैं.

Q.5 - CGST Act 2017 के Section 133 के according कौन से persons पर penalty नहीं लगाई जाएगी?
Ans. - CGST Act 2017 के section 133 के according अगर यह persons अपनी duty perform करते समय कोई भी information या contents of return disclose करते हैं तो उन पर इस section के according penalty नहीं लगाई जाएगी.
• Section 133 के अनुसार यदि government employee द्वारा offence किया जाता हैं, तो मुकदमा चलाने से पहले government से prior approval लेना होगा;

• Section 133 के अनुसार यदि non-government employee द्वारा offence किया जाता हैं, तो मुकदमा चलाने से पहले Commissioner से prior approval लेना होगा.
