INCOME TAX ACT SECTION 13A SPECIAL PROVISION RELATING TO INCOMES OF POLITICAL PARTIES

Q.1 - Political party का मतलब क्या है?
Ans. - Political party का मतलब ऐसी party से है जो Representation of the People Act, 1951 के section 29A में registered है.

Q.2 - Political party की कौन सी income को include नहीं किया जाएगा?
Ans. - कुछ condition fulfil होने पर political party की total income में house property की income, other sources की income, voluntary contributions या capital gains की income को include नहीं किया जाएगा लेकिन अगर एक भी condition fulfil नहीं हुई तो ये सारी income को total income में include किया जाएगा.

Q.3 - वह कौन सी condition है जिसे fulfil करने पर income को include नहीं किया जाएगा?
Ans. - Following condition को fulfil करना पड़ेगी जैसे कि-
• Political party के द्वारा proper books of accounts and document maintain किए गए है;
• यदि contribution amount Rs.20,000/- से ज्यादा है तो political party के द्वारा हर एक contribution या donation का record maintain करना चाहिए. यहा पर records का मतलब donors या contributors का name एवं address की details से है;
• पर ये condition electoral bond पर applicable नहीं होगी;
• Political party की books of accounts का chartered accountant द्वारा audit किया गया हो;
• Political party द्वारा Rs.2,000/- से ज़्यादा का donation, account payee cheque या account payee bank draft, या electronic clearing system या अन्य कोई electronic mode जिन्हें prescribed किया गया हो या electoral bond द्वारा ही accept किया जाए.

Q.4 - Electoral bond का मतलब क्या होगा?
Ans. - Electoral Bond मतलब वह bond जो RBI Act 1934 के section 31(3) defined किया गया है.

Q.5 - Other electronic mode का मतलब क्या होगा?
Ans. - Other electronic mode मतलब वह mode जिसे rule 6ABBA में notify किया गया है जैस Credit card, Debit card, Net Banking, IMPS, UPI, RTGS, NEFT, BHIM etc.

Q.6 - क्या political party को deduction के लिए report submit करना पड़ेगी?
Ans. - हाँ, Representation of the People Act, 1951 के under treasurer of political party या authorised person of political party द्वारा financial year में अपनी report submit करना पड़ेगी और यदि report submit नहीं की गई तो deduction भी allow नहीं होगी.
