INCOME TAX ACT SECTION 115I CHAPTER NOT TO APPLY IF THE ASSESSEE SO CHOOSES

Q.1 – Chapter XII-A (Special Provisions Relating to Certain Incomes of Non-Residents) के provision Non Resident Indian पर कब applicable नहीं होंगे?
Ans. – अगर Non Resident Indian चाहता है की chapter XII-A (Special Provisions Relating To Certain Incomes of Non-Residents) के provision उसपर applicable नहीं हो तो उसको section 139 में return of income के साथ एक declaration देना होगा जिसमे mentioned होगा के उस assessment year के लिए assessee पर Chapter XII-A (Special Provisions Relating To Certain Incomes of Non-Residents) के provision applicable नहीं हो.

Q.2 – अगर Non Resident Indian पर Chapter XII-A (Special Provisions Relating to Certain Incomes of Non-Residents) applicable नहीं होगा तो उसकी total income पर tax कैसे charge किया जाएगा?
Ans. - अगर Non Resident Indian पर Chapter XII-A (Special Provisions Relating to Certain Incomes of Non-Residents) apply नही होगा तो उसकी total income पर tax इस act के दूसरे provision के according charge होगा.
