Section 101b: Appeal To National Appellate Authority
Q.1 - यह section कब applicable हुआ?
Ans. - यह section अभी applicable नहीं हुआ है, notification द्वारा इसकी effective date notify की जाएगी.
Q.2 - National Appellate Authority of Advance Ruling (NAAAR) को कौन से appeals forward किए जा सकते हैं?
Ans. - Following appeals NAAAR को forward किये जा सकते हैं:
a) जब Advance ruling में पूछे गए किसी question पर अगर किन्ही दो state या union territories के बीच कोई conflicting advance ruling होती है या
b) Appellate authority द्वारा confirmed या modified कोई advance ruling से aggrieved applicant या officer [Sec 101 (1)] या
c) जहां appellate authority के member’s किसी appeal में दिए गए points पर different opinion रखते हैं. [Sec 101 (3) ]
इन् advance ruling से aggrieved applicant या officer जो की commissioner द्वारा authorised हो, वे appellate national authority को appeal कर सकते है.
Q.3 - NAAAR को कौन कौन appeal कर सकता है?
Ans. - Applicant, jurisdictional officers, concerned officer या commissioner द्वारा authorised कोई officer.
Q.4 - Appeal file करने का क्या time period है?
Ans. - जिस date पर last conflicting advance ruling (जिसके against appeal file करनी है) applicant, concerned officers और jurisdictional officers को communicate की जाती है, उसके 30 days के अन्दर appeal file करनी है, लेकिन अगर appeal commissioner द्वारा authorised officer द्वारा की जा रही है तो 30 days की जगह 90 days की time limit दी जाएगी.

Q.5 - Appeal को communicate करने के क्या तरीके हैं और कब माना जाएगा की order receive हो गया?

| Sender द्वारा बिना technical issue के जिस दिन mail proper send होगा उसी दिन उसका receival माना जाएगा | |
| At Common Portal | जिस दिन applicant के common portal पर order upload हो जाएगा उसी दिन उसका receival माना जाएगा |
| Publication in Newspaper | जिस दिन order newspaper में publish किया जाएगा वही दिन receipt date होगा |
| Affixing at Place of Business | वो दिन जब applicant की business place पर ruling का order affix कर दिया जाएगा |
| Registered Post/Speed Post | Generally जिस दिन master of post office को order hand over कर दिया जाए उस दिन को ही receipt date माना जाएगा |
Q.6 - क्या 30 / 90 days के बाद भी appeal file की जा सकती है?
Ans. - अगर NAAAR satisfied है की sufficient cause की वजह से appellant appeal file नहीं कर पाया तो further 30 days का period दिया जाता है.
Q.7 - Sufficient cause मतलब क्या होगा?
Ans. - Appeal period के extension के लिए authority sufficient cause मिलने पर ही satisfy होगी और ये sufficient cause depend करेगा case-to-case basis पर जो उस appellate authority की discretionary power में होगा कब वो extension allow कर सकता है या कब नहीं.
Q.8 - Appeal file करने के लिए बताए गए 30/90 days के period में क्या कोई ऐसे days होंगे जिन्हें exclude किया जाएगा?
Ans. - Act ने इस बारे में कुछ भी specifically नहीं बताया है की 30 days के count में national holidays, emergency holidays जैसे days को exclude किया जाएगा या नहीं तो ये power circumstances पर depend करेगी और authority का decision final माना जाएगा.[/expand]
