Ans. - Government notification के द्वारा Appellate Tribunal को constitute करती है.

Q.4 - Appellate Tribunal के पास क्या power होती है?
Ans. - Appellate Tribunal के पास National bench and benches thereof (Regional Bench) and State bench and benches thereof (Area bench) की power होती है.

Q.5 - Appellate Tribunal की National Bench कहा situated है?
Ans. - Appellate Tribunal की National Bench, New Delhi मे situated है.

Q.6 - Appellate Tribunal की National Bench मे कितने member होते है?
Ans. - Appellate Tribunal की National Bench मे minimum 2 member’s होते है, जिसमें Technical member from Centre और Technical member from State.

Ans. - Appellate Tribunal की Regional Bench मे 3 member होते है जिसमें judicial member, one technical member of centre, और one technical member of state.

Ans. - Appellate Authority or Revisional Authority के order के against State bench को other than place of supply के matter पर appeal file कर सकते है.

Ans. - State bench के against appeal की application high court मे फाइल कर सकते है.

Q.12 – Rs.5/- लाख से कम amount के matter के लिए bench में कितने member required है?
Ans. - 1 member require for matter amount less than Rs.5/- Lakh.

Q.13 - Bench का decision final करने के लिए कितने member की approval ज़रूरी है?
Ans. - Bench का decision final करने के लिए majority members की approval ज़रूरी है और यदि सारे members equal vote करते हैं तो उस case में जिस point में decision नहीं निकल पा रहा है उसे किसी दूसरे member को refer किया जाएगा और उसके द्वारा दिए गए opinion पर majority votes से decision को final किया जाएगा.[/expand]
