Section 158 Disclosure Of Information By A Public Servant

Q.1 - यह section कब applicable हुआ?
Ans. - यह section 1st July, 2017 से applicable हुआ है.

Q.2 - यह section किसके बारे में है?
Ans. - यह section proceeding के दौरान received information के confidentiality और उनके exceptions के regarding discuss करता है.

Q.3 – कौन सी information या documents को confidential रखा जाता है?
Ans. - Following information या documents को confidential रखा जाना चाहिये:
• इस Act के According बनाया गया कोई भी Statement/Return/Accounts/Documents उसकी details;

• वह सभी information जो किसी भी record of evidence में मौजूद हैं और जिन्हें इस Act में चल रही proceedings के दौरान दिया गया है बशर्ते इनमे criminal court में दिए गए record of evidence शामिल नहीं होंगे;

• वह सभी information जो इस Act में चल रही किसी भी तरह की proceedings में शामिल है.

Q.4- इस section के क्या exceptions है means किन situations में यह information disclose की जा सकती है?
Ans. - इसके following exceptions हैं जो निचे बताए गए हैं:
• यदि किसी other Law के लिए ऐसी Information required है; या,
• यदि Information किसी Verification Purposes के लिए required है; या,
• किसी Notice या Demand को serve करते समय Information required है; या,
• किसी Civil Court या Tribunal Proceeding के दौरान Information required है; या,
• Government द्वारा Audit करते समय Information required है; या,
• किसी भी GST Officer की Inquiry के दौरान Information required है; या,
• किसी भी Person के ऊपर Tax or Duty लगाते समय Information required है; या,
• किसी Public Servant के मांगने पर; या,
• किसी Professionals पर Inquiry के दौरान; या,
• किसी Data Entry Agency के लिए; या,
• किसी भी Government के लिए; या,
• Public Interest के Purpose के लिए.
