Section 169 Service Of Notice In Certain Circumstances

Q.1 - यह section कब से applicable हुआ?
Ans. - यह section 1st July, 2017 से applicable हुआ है.

Q.2 - Service of notice in certain circumstances को समझने के लिए और दूसरे कौन से sections या rules को refer करना होगा?
Ans. - Service of notice in certain circumstances को समझने के लिए CGST Act, 2017 के Section 169 को refer कर सकते हैं.

Q.3 - Service of notice कितने modes से दिया जा सकता है?
Ans. - Service of notice निम्नलिखित modes से दिया जा सकता है:-
• Direct courier, जो की directly taxable person के registered address पर या उसके manager को या authorized representative को या उसके Advocate को या उसके Tax Practitioner को जिसके पास taxable person के behalf पर proceedings में appear होने की authority है या उस person को जो taxable person के business में regular employee है या फिर taxable person की family के किसी भी adult member को जो उसके साथ उसके घर पर रहता है;

• Taxable person के last known business or residence address पर registered post or speed post or courier with due acknowledgement शामिल है फिर चाहे वह courier उसके authorized representative को ही क्यों न दिया गया हो;
• Taxable person के registered E-Mail address पर mail करने का जो उसने registration के समय दिया था या जो भी उसके द्वारा updated E-Mail address होगा;

• GST के common portal पर available करवा कर;

• उस area के newspaper में publish करवा कर जिस area में taxable person रहता है या business करता है;

• Last known business or residence address पर notice, decision, order, summons, या कोई other communication को चिपका दिया जाए लेकिन इस तरीके का इस्तमाल तब किया जाएगा जब बताये गए पाँचों तरीके practically possible ना हों और अगर यह भी practically possible ना हो पाया तो notice, decision, order, summons, या कोई other communication की copy को issue की गई authority या issue किये गए officer के notice board पर भी चिपकाया जा सकता है और सभी तरह के notice, decision, order, summons, या कोई other communication उस दिन से served or effective माने जायेंगे जिस दिन से उसे चिपकाया गया है;

Q.4 - किसी भी decision, order, summons, notice का communication कब मान लिया जाएगा?
Ans. - किसी भी decision, order, summons, notice का communication तब मान लिया जाएगा जब उसे publish किया गया हो या उसे tendered किया गया हो या उसकी copy चिपका कर दे दी गई है.

Q.5 - Speed post और registered post के case में decision, order, summons and notice का communication कब मान लिया जाएगा?
Ans. - Speed post और registered post के case में माना जाएगा की जितना time उस post को normally पहुँचने में लगता है उतना time expire होने के बाद यह माना जाएगा कि addressee द्वारा वह post receive कर लिया गया है unless addressee ये proof ना कर दे की उसको वह post receive नहीं हुई है.
