SECTION 43 DEFINITIONS OF CERTAIN TERMS RELEVANT TO INCOME FROM PROFITS AND GAINS OF BUSINESS OR PROFESSION

Q.1- Actual cost क्या होता है?
Ans. - Actual cost का मतलब ऐसी cost से है जिसका incidence burden assessee खुद bear कर रहा है मतलब ऐसी कोई cost जो directly or indirectly किसी other person या authority ने bear की है को cost से exclude किया जाएगा.

Q.2 - कोई सी भी ऐसी asset जो scientific research हो रही है subsequently किसी other के लिए use होने start हुई है तो actual cost क्या लेंगे?
Ans. - Section 35 के deduction actual cost में से reduce करने के बाद वाली amount asset की actual cost होगी.

Q.3 - Gifted asset की cost क्या होगी?
Ans. - Actual cost तो previous owner मानी जाएगी.

Q.4 - Amalgamation / demerged company में cost of capital asset क्या होगी?
Ans. – जहाँ amalgamation या demerger में कोई capital asset amalgamating / demerged company द्वारा amalgamated company या resulting company को transfer की गयी है, तो amalgamated company या resulting company के लिए transferred capital asset की actual cost को होगी जो capital asset की cost होती अगर amalgamating company या resulting company अपने business के purposes के लिए capital asset को hold करना continue किया होता.

Q.5 - क्या asset acquisition में interest cost को include किया जाएगा?
Ans. - नहीं, asset acquisition में interest cost को include नहीं किया जाएगा.

Q.6 - Section 43 में paid का मतलब क्या होगा?
Ans. - "Paid" का मतलब actually paid या incurred है जिसके basis पर "Profits and gains of business or profession"; head के under profits या gains को compute किया जाता है

Q.7 - Plant में क्या include किया जाएगा?
Ans. - Plant में ships, vehicles, books, scientific apparatus और surgical equipment जो business या profession के लिए use हुए है include होंगे पर इसमें tea bushes या livestock या buildings या furniture और fittings include नहीं होंगे.

Q. 8 Scientific Research का मतलब क्या होता है?
Ans. - “Scientific research" का मतलब agriculture, animal husbandry या fisheries सहित natural या applied science की fields में knowledge के extension के लिए कोई activities है.
