Section 84: Continuation And Validation Of Certain Recovery Proceedings

Q.1 - यह section कब applicable हुआ?
Ans. - यह section 1st July, 2017 से applicable हुआ है.

Q.2 - इस section को समझने के लिए और दूसरे कौन से sections या rules को refer करना होगा?
Ans. - इस section को समझने के लिए CGST Rules, 2017 के Rule 161 को refer कर सकते हैं.

Q.3 - Taxable person कौन है?
Ans. - CGST Act, 2017 के section 2(107) के according taxable person में registered person और person liable to be registered को include किया जाएगा.

Q.4 - इस section के चलते demand के reduction या enhancement का order कैसे issue किया जाता है?
Ans. - Demand के reduction या enhancement का order Form GST DRC-25 में issue किया जाएगा.

Q.5 - Notice of demand का मतलब क्या है?
Ans. - इस act के under tax, penalty, interest या कोई other amount को recover करने के respect में taxable person या other person को due amount को pay करने के लिए notice of demand issue किया जाता है.

Q.7 - Commissioner किस case में fresh notice of demand issue करेगा?
Ans. जब demand का amount enhance हो जाता है तब commissioner fresh notice of demand issue करेगा.

Q.8 - किस case में fresh, notice of demand issue नहीं किया जाता है?
Ans. - Demand का amount जब reduce हो जाता है तब fresh notice of demand issue नहीं किया जाता है.

Q.9 - अगर demand का amount reduce हो जाता है तो उस case में क्या होता है?
Ans. - Commissioner Form GST DRC-25 में किसी भी
Demand को कम करने के लिए taxable person और appropriate authority को order issue करेगा जिसके pass recovery की proceeding pending है. और appeal/revision के disposal से पहले ही शुरू की गई recovery की proceedings को उस stage से कम की गई amount के respect में जारी रखा जा सकता है जिस stage में ऐसी proceedings ऐसे disposal से ठीक पहले हुई थी.

Q.10 - अगर demand का amount enhance हो जाता है तो उस case में क्या होता है?
Ans. - Commissioner किसी भी demand को enhance के लिए Form GST DRC-25 में order pass करेंगे और appeal/revision के disposal से पहले जो recovery की proceeding चल रही थी उस stage से continue किया जाएगा जिस पर stage पर disposal से ठीक पहले proceedings रुक गई.[/expand]
