Section 98: Procedure On Receipt Of Application

Q.1 - यह section कब applicable हुआ?
Ans. - यह section 1st July, 2017 से applicable हुआ है.

Q.2 - इस section को समझने के लिए और दूसरे कौन से sections या rules को refer करना होगा?
Ans. - इस section को समझने के लिए CGST Act, 2017 के section 95, 101, 116 और CGST Rules 2017 के Rules 107A को refer कर सकते हैं.

Q.3 - क्या Authority of advance ruling (AAR) bound है की applicant या concerned officer के advance ruling के question के interpretation पर ही final ruling pass करे?
Ans. - नहीं, AAR स्वयं inquiry करके findings/interpretation निकल सकते है और ruling pass कर सकते हैं.

Q.4 - Concerned officer द्वारा AAR को records submit करने की क्या time limit है?
Ans. - नहीं, इसके लिए कोई specified time limit नहीं है.

Q.5 - क्या हर application पर advance ruling देना compulsory है?
Ans. - नहीं, AAR के pass power है की records को examine करे और applicant and concerned officer या उनके authorised representative की सुनवाई के बाद application को accept या reject कर सकता है, लेकिन कोई भी application reject करने से पहले applicant को opportunity of being heard दिया जाएगा.

Q.6 - AAR को कितने time period में advance ruling पर decision देना है?
Ans. - AAR को application receive होने के 90 days के time period में ruling pronounce करनी है.

Q.7 - क्या authority को application file करने के बाद withdraw कर सकते हैं?
Ans. - ऐसा कोई provision GST law में नहीं है, case तो case depend करेगा की applicant को application withdraw करने का right दिया जाए या नही.

Q.8 - Appellate Authority of Advance Ruling (AAAR) को matter कब refer किया जाता है?
Ans. - जब members of authority के बीच advance ruling के question पर point of difference हो, ऐसे case में AAR matter को AAAR को refer कर सकता है. AAAR को reference के 90 days के time period में ruling पर decision देना होगा.

Q.9 - AAR कब advance ruling को reject कर सकते हैं?
Ans. - AAR ऐसे issues पर applications accept नहीं करेंगे जिस पर इस एक्ट के provisions के under applicant की already कोई pending या decided proceeding चल रही हो.

Q.10 - क्या यह ज़रूरी है की application के rejection का reason AAR आर्डर में specify करे?
Ans. - हाँ, अगर application reject हो जाती है तो आर्डर में rejection के reasons specify करना जरुरी है.

Q.11 - अगर किसी issue पर already कोई pending/decided proceeding है तो क्या कोई दूसरा person same issue पर advance ruling ले सकता?
Ans. - हाँ ले सकता है अगर वो pending/decided proceeding किसी दुसरे person द्वार ली गई है स्वयं applicant द्वारा नहीं. यानी अगर applicant द्वार same issue पर कोई और pending/decided proceeding चल रही तो वह फिर से same issue पर advance ruling नहीं ले सकता.[/expand]
